311.03 Who Is Liable to Support a Spouse on TANF Financial Assistance (FAM)

Only absent parents are liable for spousal support, and then only when all the following conditions are true:

• the absent parent has been ordered by a judge to pay spousal support for the TANF individual,

• the absent parent has also been court-ordered to pay child support for some or all of the TANF recipient’s children, and

• the TANF recipient and the children live in the same household.

The Office of Child Support Enforcement Services does not establish court orders for spousal support.
